The NCAA and the state of Tennessee have reached a settlement on the lawsuit related to the NCAA’s NIL recruiting ban.
Last year, Tennessee leaders came together in support of a federal lawsuit aimed at preventing the NCAA from enforcing its NIL recruiting ban. That suit claimed the NCAA was enforcing rules that “unfairly restrict how athletes can commercially use their NIL.”
On Friday, Tennessee AG Jonathan Skrmetti praised a settlement to that lawsuit that “lays the groundwork for a permanent solution.” Skrmetti also championed the day as “a big day for the protection of student-athletes’ rights.”
“We’ve been fighting hard to protect Tennessee student-athletes,” said Attorney General Skrmetti. “Last year, we blocked the NCAA’s unlawful enforcement against Tennessee students and schools, and now this settlement in principle lays the groundwork for a permanent solution.”

With the settlement, the NCAA will not be able to restrict NIL deals. The big outcome from the settlement means that NIL collectives will be able to negotiate deals directly with prospects in high school and transfer portal players prior to a commitment from players.
We’ll see how that settlement further shapes the landscape for the new era of college athletics.
