Justin Baldoni's lawyers are saying Blake Lively may end up dropping the emotional distress claims of her lawsuit - but Lively's legal team is saying this isn't exactly the case.
Baldoni's legal team sent a letter to the judge overseeing the case Monday, June 2 claiming Lively is considering dropping her emotional distress claims from the case. They say this is because their team requested Lively's medical and mental health records, which she is reluctant to hand over.

Baldoni's attorney Bryan Freedman says they've been communicating with Blake's side about this matter, and Lively has agreed to drop the claims - with a catch. Lively wants to withdraw the emotional distress claims without prejudice, meaning she could refile later if she wanted to.
Baldoni's team, however, wants it withdrawn with prejudice, so Lively can't change her mind and refile.
Another one of Baldoni's attorneys, Kevin Fitz, blasted the actress and her team, saying "she can't have it both ways."
Baldoni is asking the judge to either force Lively hand over all the requested medical documents or to agree to dismiss the claims with prejudice.
In a statement to TMZ, Lively's lawyers said, "Once again this is a routine part of the litigation process that is being used as a press stunt. We are doing what trial lawyers do: preparing our case for trial by streamlining and focusing it; they are doing what they do: desperately seeking another tired round of tabloid coverage."
Her team also denied she was going back on the emotional distress allegations, stating, "Ms. Lively continues to allege emotional distress, as part of numerous other claims in her lawsuit, such as sexual harassment and retaliation, and massive additional compensatory damages on all of her claims.”This is the latest development in the $400 million lawsuit Lively filed against Baldoni, alleging sexual harassment and retaliation on the set of their movie It Ends With Us. Other co-defendants include Baldoni's PR team and executives of Wayfarer Studios, Baldoni's production company who produced the film.
The case is set to go to trial on March 9, 2026.
