After quick action by the Weld County commissioners, the county has been removed from a U.S. Department of Homeland Security list of “sanctuary jurisdictions” for undocumented immigrants that included the county.
On Thursday, the U.S. Department of Homeland Security released a list of immigration sanctuary jurisdictions, which included Weld County and other jurisdictions with policies against supporting undocumented immigrants. Inclusion on this list was determined by factors such as compliance with federal law enforcement, information restrictions and legal protections for undocumented immigrants.
The purpose of this list, according to the U.S. Department of Homeland Security, is to identify sanctuary jurisdictions that are “shamefully obstructing the enforcement of federal immigration laws, endangering American communities,” and “protecting dangerous criminal aliens from facing consequences and putting law enforcement in peril.” The department said jurisdictions on the list will receive formal notification of their non-compliance with federal statutes.
“DHS (U.S. Department of Homeland Security) demands that these jurisdictions immediately review and revise their policies to align with Federal immigration laws and renew their obligation to protect American citizens, not dangerous illegal aliens,” the U.S. Department wrote in the memo released Thursday night.
The county commissioners were in immediate contact with U.S. Reps. Gabe Evans and Lauren Boebert, whose congressional districts include Weld County, to request that the county be removed from the list, according to a statement released by the county on Friday. The county had not received any formal notification of any non-compliance with federal statutes, according to the release, nor does the board consider Weld County to be a sanctuary county for the purpose of protecting undocumented immigrants.
Due to the county commissioners’ prompt filing of their complaint, Evans was able to remove the county from this list, according to Delanie Bomar, a spokesperson for Evans.
“I can confirm the congressman advocated to DHS (U.S. Department of Homeland Security) about removing Weld from the list,” Bomar said. “He is personally invested in advocating for law enforcement in cities and counties, such as Weld County, who do their job despite being under Colorado’s sanctuary state ruling policies. I can confirm our office is in talks with the other jurisdictions in the Eighth Congressional District, including Adams County and Northglenn.”
The board of commissioners has continuously stood behind its opposition to providing sanctuary for undocumented immigrants, most notably with an ordinance passed in April 2024 that states: “No appropriations from general fund, capital expenditure fund, special revenue funds, or proprietary funds for the specified purpose of providing emergency sheltering of illegal aliens within Weld County.”
“The Weld County Board of Commissioners thanks both Rep. Boebert and Rep. Evans for their efforts to have this matter corrected. Their work throughout the night and this morning is a testament to their commitment to Weld County residents,” Weld County Public Information Officer Jennifer Finch wrote in the release.
