Tennessee baseball player Alberto Osuna Sanchez, who competed at a junior college, has filed a lawsuit claiming that his JUCO years should not be counted when considering his eligibility, according to a report by Yahoo Sports’ Ross Dellenger on Wednesday.
Osuna Sanchez has a pending waiver with the NCAA to play an additional season.
This lawsuit is another in a long line of them that has been filed against the NCAA regarding its eligibility rules, and this time it has everything to do with defending national champion Tennessee.

— Ross Dellenger (@RossDellenger) February 12, 2025Dellenger tweeted that this college baseball lawsuit is the baseball version of the Diego Pavia suit, which triggered the NCAA to issue a waiver to those in a similar situation. Pavia was a breakout star on the Vanderbilt football team in 2024, leading the Commodores to an upset of then-No. 1 Alabama.
According to Dellenger, the waiver does not extend to Osuna Sanchez to compete in the 2025 baseball season. Instead, the waiver extends only to those using a 4th year in the fall of 2025/spring of 2026 cycle.
This is the baseball version of the Pavia suit, which triggered the NCAA to issue a waiver to those in a similar situation. However, the waiver does not extend to Osuna Sanchez to compete in the 2025 baseball season. It extends only to those using a 4th year in Fall 25/Spring 26.

Osuna played 2 seasons at Walters State Community College in Morristown, Tenn., in 2020 and 2021 before transferring to North Carolina for 3 seasons.
