In the immediate aftermath of the Eaton and Palisades fires and as the transition from disaster relief to longterm recovery continues, the phrase “like for like” has been mentioned by politicians and local officials.
It’s been used in the context of rebuilding and trying ease residents’ concerns about red tape getting in the way of building communities back up.
Edward Rojas, an assistant deputy director with the advance planning division at the L.A. County Planning Department, said for homeowners and business owners alike, the rules around like for like are the same.
“We’re trying to make this process as simple and as straightforward as possible so just don’t overthink it,” Rojas said. “We’re allowing like for like.”
If you’re rebuilding the same use that was there before the fire with the same footprint, square footage and height as what was legally established, you’re not subject to any new or updated standards.
For those looking to rebuild with more fire-resistant materials or technology it would not be an impediment to rebuilding like for like, according to Rojas. Whatever the builder is proposing would have to comply with building codes but that review occurs after the planning department’s approval.
Rojas said there is some room for leeway. A 10% increase in height or square footage from what was previously there is allowed. In addition, while a structure should be rebuilt in the same part of the property it was before, it can be moved slightly as long as it is not a substantial change and does not encroach on a setback.
The West San Gabriel Valley Area Plan, which is set for final approval next month, included rezoning in Altadena that Rojas said does not apply to people rebuilding like for like.
“If your use was legally established you can continue that use regardless of the rezoning,” Rojas said.
