Affidavit: Man drunkenly fires rifle to intimidate other man in Greeley trailer park

A man is out on a $4,000 bond after police say he waited for another man outside a trailer following a dispute, then fired a rifle into the ground as an act of intimidation.

Police arrested the suspect, 48-year-old Antonio Nava-Martinez, who told police he’s an undocumented immigrant, in connection with the Dec. 15 incident. He faces charges of felony menacing, possession of a forged instrument, prohibited use of a firearm while drunk and disorderly conduct for illegally discharging the gun, according to Colorado court records.

    Just after 10:30 p.m., police responded to a reports of a disturbance with weapons at a trailer park in the 400 block of North 35th Avenue in Greeley. When officers arrived, the caller was waiting on North 35th Avenue, just outside the trailer park.

    The man told police he was speaking with a neighbor, when her husband — later identified as Nava-Martinez — showed up and got upset with him.

    Following a brief altercation, Nava-Martinez left the trailer and sat in his pickup truck. When the man stepped out of the trailer, Neva-Martinez stepped out of his pickup holding a gold-plated rifle, according to the affidavit.

    Nava-Martinez shouted something at the man in Spanish before opening the door to the pickup and firing a round into the ground outside.

    Police went to the scene of the shooting and detained Nava-Martinez, as well as a woman passenger in his truck. The Tribune is choosing not to name the woman because she faces no charges from the incident.

    While clearing the vehicle, police say they found a spent .22 caliber casing in plain view on the driver’s side floorboard.

    Security camera footage from a neighboring trailer shows the door to Nava-Martinez’s pickup open as the victim walked out of the trailer, according to the affidavit, followed by the sound of a a gunshot.

    Police took Nava-Martinez to the Greeley Police Department, where he originally denied that he was involved in any altercation, according to the affidavit. Police say he also denied shooting a firearm — or even owning one — until officers showed him the security camera footage.

    When officers were questioning Nava-Martinez, they could smell alcohol on his breath, records state.

    In Nava-Martinez’s wallet, police reported finding three social security cards and one driver’s license — none of which belonged to Nava-Martinez, according to the affidavit. Police say he was also in possession of four blank checks and two debit cards belonging to others.

    According to records, Nava-Martinez has a tattoo on the back of his head that read, “Pela Vacas N,” which police say is a phrase associated with cartel activity. The license plates on Nava-Martinez’s truck were registered to a 2006 Saturn SUV, and he was unable to provide officers a valid driver’s license belonging to him.

    Officers were originally unable to identify Nava-Martinez, as he told police he was an undocumented immigrant. The affidavit didn’t indicate how police finally identified Nava-Martinez.

    Nava-Martinez is scheduled to appear in Weld District Court at 10 a.m. Feb. 20 to schedule future hearings
