News10NBC’s Emily Putnam reached out to the Rochester Police Department and learned it’s not as simple as just showing up and seizing items. RPD says officers need to have probable cause to make an arrest. Every case is different and it’s up to the discretion of the responding officers.
RPD says that when officers respond to a call about illegal fireworks, they will issue citations if appropriate and collect them for disposal. After the illegal items are collected, RPD says the fireworks are handed over to the bomb squad, stored safely, and periodically destroyed.
There are dozens of tents set up in parking lots around our area right now. In general, the sparking devices sold at those tents are legal. Sparkling devices stay fixed to the ground, or they’re handheld like sparklers. If it shoots up into the air, it should not be tried at home.
RPD says illegal fireworks violate New York State Penal Code 270. If you’re caught, you could face a misdemeanor arrest and be issued an appearance ticket. Rochester Regional Health says there were 14,700 fireworks injuries reported nationwide last year.
