Carl DeMaio selling his Rancho Bernardo home, leaving rented 75th District unit

Does Carl DeMaio live in the Assembly district he’s represented since December?

Some say no — that he lives in the same Rancho Bernardo home he’s owned since 2007 in an adjacent district.

    But a spokeswoman for DeMaio told Voice of San Diego in October that the former San Diego councilman and Reform California founder lives in Fallbrook, within his vast 75th Assembly District.

    Both could soon be wrong.

    That’s because last week, DeMaio began listing for sale his 4-bed, 3-bath residence in the Westwood Valley Legends homeowners association near Lake Hodges.

    (Asking price for the 2,857-square-foot home at 18295 High Mesa Court built in 1990 is $2.4 million. DeMaio paid $1.59 million for it in 2007.)

    On Tuesday, the owner of a Jesmond Dene home — where DeMaio is renting the 600-square-foot first floor — told Times of San Diego that he’s leaving there soon.

    The owner, who didn’t want her name used, said DeMaio plans to exit May 30. The $2,000-a-month unit, at 26138 Jesmond Dene Road north of Escondido, is available for rent June 1.

    “He said that he bought a house and is remodeling it,” the owner told me. “Or it’s being remodeled, like he’s moving into it.”

    She didn’t know where DeMaio is headed.

    Republican DeMaio and his representatives haven’t responded to numerous queries.

    Neither have DeMaio’s Rancho Bernardo neighbors — Mohammad and Roya Zamanian, who in October sought a restraining order against DeMaio and his spouse Johnathan Hale.

    As first reported by Voice of San Diego, the Zamanians accused DeMaio of constant harassment.

    “They have made life miserable for us for two years,” Mohammad Zamanian was quoted as saying. “They keep telling us what kind of plants we can have. They peer at us. They threaten my kids. We just want him to stay away from us and don’t communicate with us at all.”

    But on Nov. 19, in San Diego Superior Court, Judge Rebecca Zipp denied the stay-away request after a hearing attended by the Zamanians, DeMaio and DeMaio’s attorney, James Roth.

    “The Court having fully considered the arguments of all parties, both written and oral, as well as the evidence presented, now rules as follows: Restraining order as requested is denied without prejudice in its entirety,” Zipp wrote in a minute order. “Court notes the respondent agrees to only contact the petitioner via the Home Owners Association.”

    In any case, DeMaio still faces scrutiny on how he might have broken state law on residency.

    Under Article 4, Section 2(c) of the California Constitution, candidates for Assembly or state Senate must have one year of residency in the legislative district and California residency for three years “immediately preceding the election.”

    No doubt DeMaio meets the state residency requirement. He’s voted in San Diego County since November 2005. (His record is perfect — voting in all 25 elections since that time.)

    But he changed his voter registration to the Jesmond Dene address on Dec. 4, 2023 — 11 months before the Nov. 5, 2024, election where he defeated fellow Republican Andrew Hayes 57% to 43%.

    On his latest voter registration form, DeMaio lists a mailing address of PO Box 27227 — in the 92198 ZIP code (which takes in part of Rancho Bernardo, not far from his longtime residence but 20 minutes south of the Jesmond Dene unit).

    DeMaio assumed office, replacing termed out Republican Marie Waldron, on Dec. 2, 2024 — just under a year after registering in his new district.

    The Jesmond Dene homeowner told me DeMaio had occupied her unit for a year and a half.

    I asked the owner whether he’s paid his rent on time.

    “Yeah,” she said. “He’s great.”
