OAKLAND — A man charged with deliberately running over a woman, killing her after she allegedly vandalized his car, has been sentenced to time he already served in jail, court records show.
Through a plea deal with Alameda County prosecutors, 38-year-old Marcus Davis pleaded no contest to vehicular manslaughter and formally sentenced to seven years. But Davis was also given credit for the three-and-a-half years he spent behind bars in Santa Rita Jail, doubled with good behavior, leaving him no time left to serve, court records show.
In exchange for his plea, prosecutors dropped a murder count.
Davis was charged in 2021 with killing 39-year-old Barbara Rivera. Authorities said at the time he witnessed Rivera vandalize his car then ran her over on purpose, near Foothill Boulevard and Miller Avenue in Oakland. The entire thing was caught on nearby surveillance cameras.
Davis was formally sentenced on April 22. His lawyer, Ernie Castillo, said Davis regrets making “a serious mistake during the the pandemic” and that the plea deal reflects the “unusual set of circumstances” around Rivera’s death.
“I expect Marcus will use his freedom to be a positive role model for his family and to make sure something like this doesn’t happen again, Castillo said.
