Elon Musks Custody Battles and Child Support Payments Explained

Elon Musk has navigated various custody arrangements with the respective mothers of his children.

Musk shares twins Vivian and Griffin, born in 2006, and triplets Kai, Saxon and Damian, born in 2006, with ex-wife Justine Wilson. The pair, who divorced in 2008, also shared son Nevada, who died of sudden infant death syndrome in 2002 at 10 weeks.

    Musk also shares three children with singer Grimes: X Æ A-Xii, Exa Dark Sideræl and Techno Mechanicus, who were born in 2020, 2021 and 2023, respectively. Weeks before Musk and Grimes welcomed Exa via surrogate, Shivon Zilis gave birth to twins Strider and Azure. Zilis and Musk later welcomed daughter Arcadia and son Seldon.

    Author Ashley St. Clair also claimed in February 2025 that she secretly gave birth to her and Musk’s son, Romulus, in late 2024.

    Musk had previously been candid about his desire to have a big family.

    “Doing my best to help the underpopulation crisis,” he wrote via X, the social media platform that he owns, in July 2022. “A collapsing birth rate is the biggest danger civilization faces by far. Mark my words, they are sadly true. I hope you have big families and congrats to those who already do!”

    Wilson claimed in a 2010 essay for Marie Claire that she and Musk signed a postnuptial agreement without disclosing specific details.

    “Two months after our wedding, I simply signed the postnuptial agreement,” Wilson wrote. “I trusted my husband — why else had I married him? — and I told myself it didn’t matter. We were soulmates. We would never get divorced. A life without Elon was unthinkable.”

    According to Wilson, the postnup “signed away” any claims to community property except for their house. She said that the residence was “vested in [her] name” after she gave birth to their first child.

    Wilson’s divorce lawyer ultimately tried to argue that the postnup was invalid since the author reportedly wasn’t informed of Musk’s significant business holdings when she signed the document. The judge ruled in Musk’s favor to uphold the document.

    Details of their custody arrangements are unknown, though Musk is estranged from daughter Vivian. She claimed on multiple instances that the Tesla founder did not support her when she publicly came out as transgender.

    “He was not as supportive as my mom,” Vivian claimed in a 2025 profile in Teen Vogue. “First of all, I had not talked to him in months — in months — so I had to get parental consent to get testosterone blockers and [hormone replacement therapy].”

    Per Vivian, she also only found out about Musk’s kids with Grimes, Zilis and St. Clair through the internet.

    “I don’t keep up with that side of the family because … I don’t. My mom doesn’t really either. She’s divorced, werk,” Vivian added. “I don’t really [care] what they do. This is not my problem, OK?”

    Grimes (real name Claire Boucher) filed a “petition to establish parental relationship” over her three kids with Musk in September 2023. While the court documents were sealed, the musician later claimed via X that she had exhausted her bank account during the legal battle.

    “Spent a year locked in battle in a state with terrible mothers rights having my Instagram posts and modeling used as reasons I shouldn’t have my kids and fighting and detaching from the love of my life as he becomes unrecognizable to me, with a fraction of his resources (or iq/ strategy experience), all the while I didn’t see one of my babies for 5 months,” Grimes alleged in November 2024. “And this is only what can be said publicly, since most of my experience these last years should remain behind closed doors.”

    Musk has not publicly addressed his custody battle with Grimes. He has since brought their eldest son, X, to many public events in 2024 and 2025, which Grimes publicly condemned.

    “I have tried begging the public and my kids’ dad to keep them offline, and I’ve tried legal recourse,” she tweeted in March 2025. “The state of my children’s lives being public is of grave concern to me, and I think about how to solve this every day. It’s insane to me that there’s no way to deal with this. I would hope there was some law that would allow a parent to veto small children from living public lives, but I don’t even trust the law to help me now if I tried to invoke it tbh.”

    Musk’s parenting plan with Zilis, a Neuralink executive, has not been publicly shared. A bombshell Wall Street Journal report in April 2025, however, claimed that Musk gives Zilis “special status.”

    “Musk chooses to spend time at her home in Austin as well as bringing her to high-profile public events,” the WSJ claimed, further alleging that Zilis and her four kids live on Musk’s estate in Texas.

    Musk appeared to deny the report, tweeting, “TMZ >> WSJ.”

    St. Clair revealed in February 2025 that she gave birth to her son with Musk several months earlier. St. Clair subsequently filed a lawsuit in New York, petitioning for sole custody of Romulus and asking for Musk to submit to a DNA test.

    “I don’t know if the child is mine or not, but am not against finding out. No court order is needed,” Musk wrote via X in March 2025. “Despite not knowing for sure, I have given Ashley $2.5M and am sending her $500k/year.”

    The WSJ alleged the next month that Musk had previously offered St. Clair a one-time $15 million sum and an additional $100,000 per month to keep their son’s existence a secret.
