A woman is facing three charges of attempted first-degree murder of an officer after police said she stole a rifle from a Weld County Sheriff deputy’s cruiser while in custody, racked it to prepare it to fire, then pointed it at two deputies and a captain.
Police arrested 33-year-old Katya Myers on April 4 after she rummaged through multiple yards in a Weld County neighborhood — attempting to set one man’s shed on fire — before stealing the rifle in the patrol vehicle, according to an affidavit for her arrest. She faces 14 felonies — and 32 total charges — from the string of events earlier this month, Colorado court records show.
Around 7:30 a.m. April 4, Weld County Sheriff’s Office deputies responded to a trespassing call in the 4200 block of Grand Teton Road in the Hill N Park neighborhood south of Greeley. The caller said an unknown woman walked into his backyard and swung a shovel at a security camera attached to a garage on the property. After knocking the camera off the shed, she put it in her pocket and walked away, the man told police.
Officers were unable to locate the woman in the area, but spoke to the man who said he found a different security camera — which didn’t belong to him — in his backyard once the woman left, according to the affidavit.
Just after 11:30 a.m. April 4, deputies were dispatched to a report of a burglary in the 4200 block of Olympic Drive, also in the Hill N Park neighborhood. The caller said he was doing dishes when he saw a woman in his backyard through a kitchen window.
The man told police he ran outside to confront her and when he did, she told him that he and his family were “going to blow up,” and called the man a racial slur before walking away, according to the affidavit.
Police said the man heard a noise from a shed in the back yard, and when he went to look, everything had been thrown around and covered in gasoline. The man also noticed a saw was running, with something tied to the saw’s trigger, causing it to continuously run and begin to get hot, according to the affidavit.
She faces two counts of first-degree burglary for entering the two backyards, as well as two counts of arson and one count of manufacturing an explosive for trying to set the shed on fire, according to Colorado court records. She also faces a charge of committing a bias-motivated crime after yelling the racial slur, records show.
As deputies were en route to the address on Olympic Drive, police said the man from the earlier trespassing call on Grand Teton Road told them the woman had returned to his property. When deputies arrived, they located her kneeling in the man’s shed, according to the affidavit.
Deputies say they found a crowbar in her bra and placed her in the back seat of a police cruiser.
The woman gave deputies a fake name and refused to tell them her birthday, police said. Later, they identified the woman as Myers.
As police were gathering evidence on the scene, one deputy was speaking with Myers, but couldn’t make out what she was saying because of the closed police patrol car door. so the deputy walked away from the window, according to the affidavit.
Another deputy returned after Myers started loudly banging on the door of the patrol car, according to the affidavit. When the second deputy opened the door, Myers was pointing a rifle directly at her, according to the affidavit. Police said she grabbed the end of the rifle and pointed it toward the front passenger seat while yelling, “Gun! Gun! Gun!”
Another deputy ran to the vehicle, pointing his gun at Myers, telling her to drop the rifle, according to the affidavit. The first deputy was able to get the rifle from Myers and pulled her out of the vehicle, police said. A captain cleared the rifle and found it had jammed after it was loaded, according to the affidavit.
Deputies noticed Myers had slipped her left hand out of the handcuffs and deputies re-secured her in cuffs and placed her in another patrol vehicle, according to the affidavit.
When investigating the vehicle Myers was in, deputies saw that, once she got her hand out of the cuff, she pulled back a piece of plexiglass separating the area where suspects are transported and the back of the vehicle where additional equipment is held, according to the affidavit. Police said she “had access to grab multiple items” and chose to grab the rifle bag.
The rifle was unloaded with a full magazine, and Myers pulled the charging handle to rack the gun before pointing it at the two deputies and a captain, according to the affidavit.
She faces three counts of attempted first-degree murder of an officer — one after deliberation for the deputy who opened the door, and two by extreme indifference for the other deputy and the captain — and three counts of felony menacing, as well one count each of attempted escape and possession of a weapon by a previous offender for grabbing the rifle and pointing it at officers, according to Colorado courts records
Police said they were not able to identify Myers until she was booked and fingerprinted at the Weld County Jail. Records show she pleaded guilty to one count of attempted felony escape in 2013 in Alamosa County.
Myers has a hearing on advisement on April 15 in Weld District Court.
