U.S. Rep. Gabe Evans of Colorado’s 8th Congressional District introduced his first bill in the U.S. House of Representatives on Thursday, aiming to prohibit state and local governments from restricting law enforcement efforts to help detain undocumented immigrants.
The Unhandcuffing Police to Locate and Interdict Foreign Transgressors (UPLIFT) Act pushes back against Colorado’s sanctuary state policies by supporting local police get dangerous criminals off the street, according to a news release from Evans’ office. The bill is supported by U.S. Reps. Lauren Boebert and Jeff Crank who represent Colorado’s 4th and 5th congressional districts.
The UPLIFT Act targets the three policies highlighted in a letter Evans led with Boebert and Crank to Gov. Jared Polis on Jan. 21 about Colorado’s immigration problems. The bill will counter three Colorado House and Senate bills by prohibiting state and local governments from passing legislation to prevent law enforcement from aiding in the detainment of undocumented immigrants who have committed a crime.
“When you have a clearly defined threat like that, there is a constitutional and federal prerogative to make sure we are protecting our community and protecting our country,” Evans said in his announcement video for the bill.
Under Colorado House bills 23-1100, 19-1124 and Senate Bill 21-131, law enforcement is not required to comply with federal requests that they share information about undocumented immigrants suspected of a crime or facilitate contracts with private companies that use public facilities to detain them.
The UPLIFT Act would also clarify the authority of Immigrations and Customs Enforcement detainer requests and grant legal immunity to local officials who comply with them.
If Evans’ bill passes, then those protections for undocumented immigrants would be in jeopardy.
“This is something we talked about on the campaign trail,” Evans said in the release. “(This bill) does exactly what it says it does, making sure that our state and local law enforcement is empowered and uplifted to be able to work with their federal counterparts to be able to get folks who are committing crimes in our community and who are illegal present out of our communities.”
