DPS files for restraining order to prevent ICE enforcement on school property

DENVER (KDVR) -- Denver Public Schools has filed a motion for a temporary restraining order to stop the Department of Homeland Security from revoking schools' sensitive location status preventing immigration enforcement actions.

The DHS rescinded 2021 guidelines in January that restricted two key federal immigration agencies — Immigration and Customs Enforcement and Customs and Border Protection — from carrying out immigration enforcement in sensitive locations, which included schools.

    DPS in a press release Wednesday evening said the decision created "uncertainty" for their district and that they are the first district in the country to file a motion to stop the revocation. They said they hope others will follow.

    While DPS may be the first public school district to file this motion, the hope is that other districts across the country will exercise their power and take action toward protecting their school communities. The filing of the TRO further signifies that DPS remains committed to providing the highest-quality education and ensuring that schools are safe, welcoming, inclusive, and supportive environments for all students."

    The district announced the motion after "several ICE arrests took place in neighborhoods surrounding some DPS schools earlier this morning, negatively impacting families and students."

"District students belong in their schools and deserve to feel safe, regardless of their immigration status or the status of their families."
