Even as the bigger debate swirls over whether or not bail reforms are responsible for crime increases in New York, we’ve pointed out many times that a huge problem with the statutes passed by the Legislature and signed by Gov. Cuomo in 2019 — then reactively amended three times since, all in closed-door, no-hearing budget negotiations — is that they refuse to explicitly give judges discretion to consider the potential dangerousness of a defendant in setting pretrial detention.
