Alberto Osuna wants to play some more baseball for defending national champion Tennessee.
The Volunteers first baseman filed a motion in federal court on Monday, asking the court to reconsider his eligibility case after a ruling in the District Court of New Jersey that awarded Rutgers football player Jett Elad an injunction that gave him added eligibility for this fall. The Elad decision was similar to the decision in the case of Vanderbilt star quarterback Diego Pavia.
Elad played 2 seasons at Ohio in 2020 and 2021 after redshirting in 2019. He spent 1 season at Garden City Community College, then transferred to UNLV for the 2023 and 2024 seasons. Elad successfully argued that his year at Garden City Community College in 2022 should not count toward his eligibility.
Osuna has attempted to argue the same about his 2021 season at Walters State Community College in Morristown, Tenn. But he was twice denied eligibility in court after he transferred to Tennessee in January. Osuna also played at the JUCO program in 2020, a season that does not count against his eligibility due to COVID-19.
Because Elad and Pavia were granted eligibility, the filing noted that the decision in the Osuna case is the outlier because the courts in those previous cases reviewed testimony from the same expert witness in Dr. Joel Maxcy − who was relied on in Osuna’s case and reached the same conclusion.
Osuna’s case is following the legal argument that was made by Pavia, who successfully gained eligibility from seasons he played in junior college when the NCAA granted him a waiver after he filed suit.
