AMERICANS affected by a major data breach are in line to receive payments of up to $5,300 as part of a settlement agreement.
An eye care centre in Maryland and Virginia has agreed to a $3.6 million class action lawsuit settlement to resolve claims it failed to prevent a data breach back in 2023.
GettyPayments of up to $5.3k could be made through the settlement[/caption]Anyone whose data was potentially accessible in a Retina Group of Washington (RGW) breach on March 26 of that year is set to benefit.
Patients swiftly took legal action, arguing RGW could have prevented the breach with appropriate cyber-security measures.
RGW has not admitted any wrongdoing.
However, the eye care centre has agreed to this settlement to resolve the claims.
The breach reportedly jeopardised information including Social Security numbers, health insurance data and driving licence numbers.
Class members can either get a cash reimbursement or alternative cash payment under the terms of the settlement.
Those who experienced losses due to the breach can get up to $300 for ordinary expenses.
This includes up to four hours of lost time at $25 per hour.
In addition, claims for up to $5,000 are included in the settlement for extraordinary losses from identity theft or fraud.
Class members who did not experience losses can also receive an alternative cash payment of around $100.
An option of two years of free credit monitoring and identity theft protection services is also available.
However, class members who choose the alternative cash payment are not eligible for the credit monitoring.
Documentation of unreimbursed expenses are required as part of any claim.
This might include bank fees, phone or data charges, postage, gas, or credit report fees.
The deadline for claims is June 23 of this year.
Anyone who does not qualify for a settlement should not file a claim.
A final hearing is set for June 9.
It follows another instance of major payouts for Americans affected by a mass data breach.
A $9.95 million settlement was reached previously after a breach at a student data firm based in Virginia.
Walgreens shoppers can also get one-time payments as part of a £100 million settlement.
It is settling claims that it charged insurance companies more than it should have for prescription drugs.
Again, Walgreens has not admitted any wrongdoing and is paying out to settle the claims.
Customers who paid for prescription drugs from Walgreens between January 1, 2007, and November 18, 2024 are eligible.
