After a lengthy legal battle, Erika Jayne’s estranged husband, Tom Girardi, was sentenced to seven years and three months in prison.
News broke on the disgraced attorney’s 87th birthday in June 2025 that he would need to serve time in jail after being convicted of wire fraud.
Girardi was found guilty on four counts of fraud in August 2023 after being accused of allegedly embezzling more than $15 million from multiple legal clients.
“Tom Girardi built celebrity status and lured in victims by falsely portraying himself as a ‘Champion of Justice,’” United States Attorney Martin Estrada said in a press release at the time. “In reality, he was a Robin Hood in reverse, stealing from the needy to support a lavish, Hollywood lifestyle. Today’s verdict shows that the game is up — we can all now see this defendant for what he was and the victims he callously betrayed.”

Akil Davis, who serves as the Assistant Director in Charge of the FBI’s Los Angeles Field Office, also released a statement on Girardi’s conviction.

Girardi, who separated from the Real Housewives of Beverly Hills star in 2020 just before the legal battle made headlines, pleaded not guilty to the charges in a 2023 indictment.

When Will Tom Girardi Report to Prison?
Despite his June 3, 2025, sentencing, he will have nearly a month before he needs to report to the facility. According to a Department of Justice press release, the judge ordered Girardi to surrender to authorities by July 17, 2025.
Once booked at the prison, which has not been made public yet, Girardi is set to serve a sentence of seven years and three months.

Throughout the duration of his trial, Girardi was residing in an assisted care facility. He was diagnosed with Alzheimer’s disease and dementia in 2021. His lawyers attempted to argue that he was not mentally fit to stand trial, which was ultimately shut down in court.
Tom Girardi Will Also Pay Fines and Restitution
The judge also ordered Girardi to pay a $35,000 fine and $2.3 million in restitution to his former clients.

“This sentencing brings a level of recompense for countless victims of Mr. Girardi’s long-running scheme to enrich himself on the backs of clients who trusted him in some of their worst days,” Tyler Hatcher, who works as a special agent in charge for the Los Angeles’ IRS Criminal Investigation, said in a statement. “Mr. Girardi thought he could outsmart his victims and investigators, but this sentencing demonstrates criminals cannot evade the unrivaled acumen of IRS-CI special agents in following the money, as well as the effectiveness of our partnerships with fellow law enforcement organizations like the FBI.”
United States Attorney Bill Essayli, meanwhile, pledged to continue “vigorously prosecuting corrupt lawyers and those who assist them in criminal activities.”
