The Syrian President in the transitional phase, Ahmed al-Sharaa, issued a decree to cancel precautionary asset seizure orders imposed on Syrians between 2012 and 2024.

Finance Minister Mohammed Yosr Bernieh said to the Alikhbaria Syria channel today, Monday, May 12, that the property seizure orders were based on unjust directives from security agencies and were not based on judicial procedures or rulings, and were issued against citizens due to their support for the Syrian revolution.

He added that this step reflects the will of the Syrian state “to lift the injustice from people and restore the wheels of economic activity,” as he expressed.

According to Alikhbaria, the minister apologized on behalf of the Ministry of Finance to all those affected by these “unjust and wrongful” decisions that deprived more than 91,000 Syrian citizens of their properties and assets.

The minister stated that the ministry will ensure, in cooperation with the Ministries of Justice and Interior, to quickly take the necessary measures to put the decree into effect.

After the fall of the Syrian regime, the issue of seized properties has returned to the forefront, raising questions about how to recover them after years of illegal control by individuals and entities linked to the former regime, and the legal procedures necessary to ensure the return of rights to their owners.

The Ministry of Local Administration in Syria had previously mentioned on January 5 that the previous regime’s rule witnessed widespread theft of public and private properties and systematic forgery of sale and purchase contracts, threatening the rights and properties of citizens.

Figures close to the former regime exploited chaos and the displacement of residents to seize their properties illegally, either through threats or forgery, and later sold them to citizens with forged contracts without the knowledge or consent of their original owners.

After the regime’s fall, owners attempted to return to their properties, and among the cases that successfully recovered their properties were the heirs of Burhan al-Azem and lawyer Osama al-Mouaid al-Azem and his brothers, who managed to reclaim their building in the al-Jabba area of the Syrian capital, Damascus, which had been seized under a forced rental contract since 1963.

Since the beginning of 2011, the previous Syrian regime issued a series of laws and legislative decrees related to property rights, which affected Syrians inside and outside the country. They included the seizure of movable and immovable properties of political opponents or sympathizers with the Syrian revolution, including artists, intellectuals, and traders, who were charged with supporting what is known as “terrorism.”

The Counter-Terrorism Law No. 19 of 2012, in Article 12, stated that “in all crimes stipulated in this law, the court shall issue a conviction ruling to confiscate movable and immovable assets and their proceeds, as well as things that were used or intended to be used in committing the crime, and shall order the dissolution of the terrorist organization if it exists.”
