The money comes from a class action lawsuit filed against New York City.

The suit accuses the Department of Correction of holding people in custody longer than they were legally allowed to.

The detentions occurred between April 1, 1997, and December 21, 2012, and were reportedly triggered by requests from U.S. Immigration and Customs Enforcement (ICE).

This is even after individuals had satisfied all other conditions for their release.

The lawsuit claims that while ICE detainers only authorize holding a person for up to 48 hours, the city allegedly exceeded this limit on numerous occasions, unlawfully keeping people behind bars.

The Department of Correction oversees New York City’s jail system, rehabilitation programs, and other correctional facilities,

Though New York City denies any wrongdoing, officials agreed to the massive settlement.

While no proof is needed to be eligible, there are two main criteria that divide claimants for the settlement.

SETTLEMENT GROUPS

The Statute of Limitations Group, or the group of people held between 1997 and 2007, could receive $10,000 to $24,000 each.

The Recent Group, which were people held between 2007 and 2012, may be eligible for $20,000 to $48,000 payouts depending on how long they were over detained.

No proof of detainment is required to file a claim.

But eligible individuals will need to fill out a claim form, either online or by mail, by May 15, 2025.

Those wishing to opt out or object to the compensation must also do so by that date.

A final court hearing to approve the settlement is scheduled for October 6, 2025.

Until then, claims are being collected through the official settlement website and by mail.

With payouts reaching up to $48,000 per person, it’s worth checking the details before the opportunity slips away.

But remember, you’ll have to submit your claim form by May 15, 2025, to avoid missing out.

What's a class-action settlement?

Class action lawsuits offer groups of people, or 'classes,' a way to band together in court.

These suits are often brought by one or a few people who allege a company or other entity has wronged a large group of people.

When a suit becomes a class action, it extends to all “class members,” or people who may have similar complaints to those who filed the suit.

Companies often settle class actions – offering payment to class members who typically waive their right to pursue further legal action by accepting money.

These payout agreements frequently include statements by the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination, or false advertising are a few examples of what can land a class action on a company’s doorstep.
