Ex-Trump DHS chief rebukes Boasberg deportation rulings as ‘nonsense’ ...Middle East

News by : (The Hill) -

Trump ally Chad Wolf on Thursday rebuked Judge James Boasberg’s ruling over the Trump administration's deportations of people to El Salvador as “nonsense.”

Wolf, a former acting secretary of the Department of Homeland Security during President Trump’s first term, criticized Boasberg during an appearance on CNN, specifically calling out the judge's move to hold the Trump administration in criminal contempt after disobeying his order to halt deportations under the Alien Enemies Act.

“I do think it will end up before the Supreme Court,” Wolf said. “Look, the judge’s ruling to begin with was nonsense, to turn planes around in the middle of those flights.”

Wolf noted that “obviously” the Trump administration disagrees with Boasberg’s ruling.

The battle began after Trump invoked the war-time Alien Enemies Act to deport members of a Venezuelan gang.

Boasberg ordered the administration to not let the deportation planes take off for El Salvador or to turn the planes around if they had already left the United States.

The administration insisted it was not defying a court order because the planes had already left U.S. territory by the time the order was handed down.

Boasberg on Wednesday found probable cause to hold the administration in contempt for willfully disobeying his order.

Wolf noted that the administration is going to appeal and it is “likely to go to the Supreme Court yet, once again.” He also argued that the case may belong in Texas court.

According to a previous Supreme Court order on Boasberg's initial ruling, detainees under the Alien Enemies Act are entitled to notice and an opportunity to challenge their removal from the country.

The court said it would have to be reviewed by judges in districts where the migrants are confined, which would be Texas in this case, meaning the conservative 5th Circuit Court of Appeals, The Washington Post reported.

“If we remember, the Supreme Court has already said in one case that, that type of filing doesn’t belong with … this judge,” Wolf said of Boasberg. “It actually belongs in the state of Texas, in the Fifth Circuit.”

“So, there’s more to be played out here and obviously, there’s more declarations by the Department of Justice,” he said.
