A Marin County Superior Court judge reinstated criminal proceedings for a San Rafael woman accused of killing her mother last year.
Tonatzyn Oris Beltran, 30, pleaded not guilty by reason of insanity to her murder charge in September. On Thursday, Judge Geoffrey Howard reviewed a mental health report that deemed Beltran competent to stand trial. He set the next hearing for May 14.
The defendant underwent mental health evaluations after her defense attorney declared doubt in her competency for trial. Beltran’s attorney, Matthew Siroka said that her mental state declined in jail and she needs hospital treatment.

Officers saw her standing with a knife in her hand while her mother laid next to her on an apartment balcony, authorities reported. The police said that the defendant broadcasted the incident live on social media.
Siroka said it is now up to the prosecution to agree if Beltran was legally insane during the time of the incident. He said he hopes that his client will be transferred to a state hospital instead of undergoing a trial.
“That’s the outcome that we’re hoping for, the community wants, the family wants and is appropriate given her serious mental illness,” he said.
Prosecutor Roopa Krishna declined to comment after the Thursday hearing.
