The company is accused of failing to prevent a data breach that occurred on April 25, 2023, per Top Class Actions.
This incident compromised sensitive information of patients, including things like Social Security numbers (SSN).
WellNow has not admitted to any wrongdoing, but is paying out the sum to settle the claims.
The data breach settlement implicated 597,000 individuals who had their information stolen.
PAYMENT GROPUS
Those who are set to benefit from the payout fit into two separate groups.
The first group is the majority of the overall class member count, and is made up of those who did not have their SSN-related information compromised.
This group implicated 541,870 of the 597,000.
The second group includes those who did have their SSN information stolen, and accounts for the remaining 55,131 claimants.
HOW MUCH WILL YOU BE PAID?
It’s important to understand what each group is eligible to receive.
Those who fit into the non-SSN group can receive up to $7,500 for out-of-pocket expenses related to the breach.
This includes things such as credit expenses and identity theft losses.
This group is also eligible to claim up to two hours of lost time at a rate of $25 per hour.
Those in the SSN group are also eligible for $7,500 for the same out-of-pocket-expenses, but there are a few differneces.
Firstly, the SSN group can claim up to three hours of lost time at a rate of $25, instead of two.

Given that pro rata refers to an equal proportion, this means that SSN members can decide to receive an equal share of the fund, whatever that amount will be.
Instead of claiming the flat $7,500, SSN members have the opportunity to claim a potentially larger amount, depending on how many claims are filed.
WHEN IS THE DEADLINE TO CLAIM?
In order to claim, you need to provide documentation proving you suffered losses as a result of the WellNow data breach.
Only those who had their information compromised on April 25, 2023 are eligible to claim.
