MarineMax is a lifestyle retailer of recreational boats and yachts, with locations across the US.
Claimants have alleged that the company failed to prevent a 2024 data breach.
It is alleged that MarineMax did not implement reasonable cybersecurity measures to prevent the breach.
Hackers gained access to information including Social Security numbers, driver’s license numbers and bank account information.
It is important to stress that the company has not admitted to any wrongdoing, and is instead paying out the cash to settle the claims.
MarineMax is paying out a settlement total of $1,018,825.50.
Those who are eligible for payment would have already received a letter from MarineMax or Newcoast.
This was to inform them that their data had been compromised as a result of the leak.
HOW MUCH WILL YOU BE PAID?
Under the terms of the agreement, Americans are eligible to receive up to $5,000 for identity theft losses and up to $2,000 for out-of-pocket expenses.
But proof is needed of those expenses in the form of a document.
Documented expenses can can cover professional fees, credit expenses, credit monitoring costs and other expenses.
This means that if you can prove you were personally damaged by the leak in the form of a professional expense, for example, you can claim.
Once these main claims are removed from the fund, those who do not have a proof of eligibility will enjoy a pro rata share of the remaining cash.
Pro rata refers to a proportion, meaning that they rest of the money will be shared out equally.
What's a class-action settlement?
Class action lawsuits offer groups of people, or 'classes,' a way to band together in court.
These suits are often brought by one or a few people who allege a company or other entity has wronged a large group of people.
When a suit becomes a class action, it extends to all “class members,” or people who may have similar complaints to those who filed the suit.

But these payments will be capped at $500 per person.
Those who did not ask for the two years of credit monitoring initially offered by MarineMax can receive up to three years of one-bureau credit monitoring.
Those who did can receive an addition additional 12 months.
WHEN IS THE DEADLINE?
Those who believe they are eligible for reimbursement need to act fast, as the deadline is approaching.
The deadline for exclusion is scheduled for May 14, 2025.
Meanwhile the deadline for a claim form is closing on June 13, and if you do not submit a form by then you will miss your chance.
The final approval hearing for the MarineMax data breach settlement is June 17, 2025.
If you do not believe you are eligible for the suit, you should not submit a form.
