A new law that prohibits people from using a mobile device while driving goes into effect with the new year.

The Colorado Hands-Free Law expands the current ban on texting while driving to include “holding or manually using a phone or other mobile” device for any reason, including voice calls, according to a social media post from the Greeley Police Department.

Under the new law, drivers can only use hands-free accessories or devices, including dashboard or phone mounts, built-in car speaker systems, Apple CarPlay or Android Auto.

The hands-free rule aims to reduce distracted driving crashes and enhance road safety throughout the state, police said. The Greeley Police Department reported that 77% of Colorado drivers admitted to being distracted by their phones while driving.

Distracted drivers put pedestrians and bicyclists at particularly high risk, according to the department. Deaths among pedestrians and bicyclists increased by 50% and 112.5% from 2015 to 2023.

First-offense law violations will result in a $75 fine and two license suspension points, but penalties will increase for repeat offenders, the Colorado Department of Transportation reported. First-time violators can receive dismissed charges with proof of purchasing hands-free accessories.

The law does not apply to people with a commercial driver’s license operating a commercial vehicle or those “reporting emergencies, utility workers, code enforcement officers, animal protection officers, first responders and individuals in parked vehicles,” according to the Colorado Department of Transportation.
