DENVER (KDVR) — Starting Jan. 1, 2025, drivers in Colorado will no longer be able to use any handheld devices such as cell phones while driving. The law banning this was passed in 2024, though drivers under 18 were already barred from the activity.

In a "frequently asked questions" explainer about the new law, the Colorado Department of Transportation answered a question about the use of headphones as it pertains to the new law, which is meant to encourage the use of hands-free devices.

As it turns out, lawmakers settled the matter of using headphones while driving long before this new law was passed.

Is it illegal to wear headphones while driving in Colorado?

It depends, but mostly yes.

The Colorado law banning the use of things like headphones and earbuds while driving specifically bans the use of "earphones," which the law goes on to explain are "any headset, radio, tape player, or other similar device which provides the listener with radio programs, music, or other recorded information through a device attached to the head and which covers all of or a portion of the ears."

However, there are some exceptions to what earphones are, including speakers or listening devices built into protective headgear or devices that only cover all or a part of one ear.

These exceptions were added in 2015, though the law itself dates back to sometime before 1995.

CDOT has said this law is so that people can hear important sounds like sirens or horns while driving.

Violating the law is considered a Class B traffic infraction. According to the Colorado Revised Statutes, the penalty is a $15 fine with a $6 surcharge.
